The Industrial Property Act
The Industrial Property Act 2014 entered into force on 1 March 2015 and is viewed as a much improved foundation in the jurisdiction, more in line with the Paris Convention, the Patent Cooperation Treaty, and the WIPO convention.
Innovation, creativity and brand image are extremely valuable assets for any organisation and our firm is ready to assist with the protection of these assets through registration of the intellectual property firstly and litigation if and where necessary.
Registering your Intellectual Property with the Chambers is advised as we have a complete service package from the outset, allowing us to thoroughly and completely protect your rights.
Protecting Brands Across Borders
- Goods and Services Trademarks
- Certification Marks
- Collective Marks
- Three-Dimensional Marks
Seychelles is a signatory to the Paris Convention providing for the same national treatment, the right of priority and lays a few common rules for the numerous contracting states.
The registration of a trademark is valid for 10 years, from the filing date of registration, and 7-year renewal periods are permitted thereafter.
The registration period is quite lengthy. However, we pride ourselves in being the fastest service provider in the country. We achieve this by ensuring that each application is tagged and tracked, from start to finish, and by ensuring we stay in constant contact with the registry to receive confirmation in the fastest possible time frame.
copyright:
The Copyright Act 2014 allows for protection of the following creative works:
- Literary
- Musical
- Artistic
- Performance
- Films
- Sound
Seychelles is not at present a member of the Berne Convention.
Patent
Patents have seen an extension of the term from 14 to 20 years, under the latest legal regime.
“A law is valuable, not because it is a law, but because there is right in it.”
Litigation
Our Seychelles intellectual property lawyer also represents clients in IP litigation, as and when the need arises.
We believe that the registration of intellectual property rights, without looking to enforce them, defeats the purpose of registration to begin with. We specialize in protecting these rights, as set out in the law, so that our clients receive full value for their efforts in building their brand. The Chambers is easily reachable to answer queries and is confident in enforcing the claims of our clients.
